I know that Android's OS versions are more fragmented, because they're controlled by Google, handset manufacturers AND carriers (in contrast to the iPhone being solely controlled by Apple), but I always thought hardware, not software, fragmentation was the big issue.

There are about 80 different Android smartphones that have been released according to Wikipedia. That is more than what RIM have released in the last 15 years, including their pagers and carrier-specific versions, and a lot more than the 4 iPhones and 5 webOS smartphones.

I can't speak much about consumer-side of things, but as a developer, I can tell you that developing for iOS and webOS is easier and cheaper because there are less devices. I test on every iOS and webOS device, but on less than 10% of the available Android devices, because of the cost caused by so many devices.

I dont think so. The ambient light sensor is next to the iSight camera. I'd wager the indicator light is most oft on when the lid is closed and the sensor unexposed to ambient light. It's just dimmer.

OS X and Windows have licensed encoders, right? Is it possible for Firefox and others to use those on OS X and Windows and use a less-than-legal decoder on Linux as is, AFAIK, done for MP3s and DVDs?

The designs are each unique enough that I wouldn't call them iterations or tweaking, but exploration of different ideas, which — especially for mockups — is normal in design.

If they had contacted their patent lawyer earlier than they had, they might have avoided jumping the gun with their first blog post and their only blog post might have been explaining why the twittersphere and blogosphere were overreacting.

The spec work of this sort is not a proposal; it is the actual work. Your analogies in other fields break down, because for the designers, this work is like the lawyer's case (not a consultation) and like the consultants "large project".
