So what reasons are there to use flash over HTML5, I ask myself and the HN crowd?

Android and Chrome will revive the netbook. They are free (as in beer) OSes, and run with very minimal hardware. As such, devices having one of both OSes will be the OLPC replacement. As the third world has either very old or no computer, those cheap devices will flood the market. Netbook formfactor will be part of them, as desktop work will still be needed.

These are no icons whatsoever. These are high resolution images with way too much detail to be ever used as icons.

Even in the 'normal way' theft is not the same as taking something or copying something. Maybe a lot of interpretations of taking/copying are labelled theft; it does not mean the term theft is used correctly. In this case, I would argue that theft is pretty much equivalent to the legal definition.

Theft means you take something away. You don't take something away when you copy the execution. As such, it cannot be theft. The counterargument that you take away revenue is hypothetical at best, and still not taking something physical directly away from the owner.

You contradict yourself when stating innovation is improving current executions of ideas. Too much of this, and suddenly it's something called theft?

If you merely copy the execution of the competition 1:1, you won't win over your competitor. You need to offer a key advantage. That's where the innovation takes place: the small step differentiating your execution from the original. In doing so, you don't steal, but add something. Adding something can never be stealing.

Every new web technology will be littered with security vulnerabilities. That's inherent to new technologies. The article does not make it clear for me what _inherent_ problems exist with regarding to security and WebGL.

Web workers can be silently used for data crunching. WebSockets can be used for DDoS attacks. CSS visited links could be used to know what history you have. But as the web progresses, these problems will be smoothed out. As such, the security problems with WebGL probably will be solved too.

Is it very far fetched to think Microsoft sees WebGL as a big threat to their Xbox/PC gaming/DirectX/Silverlight establishment?

What a complete nonsense. The industry moves in certain directions, and everyone is inspired by everyone else. Because there is a thriving legal industry, they call iit "stealing ideas" and "copying". There is no such thing as original design, every design is based on previous designs and adds small new things.

IE8 does not do html5. Therefore, it's a legacy browser. Makes perfect sense to me.

I think the "File" menu is there because since everyone is used to it, it is expected. Other then that, I don't see a list of files, but I do see a list of documents. Subtle difference, big impact. A document is a file (however, I doubt even that at gdocs), but a file is not necessarily a document. Personally I want to work with documents, not so much with files. Lowlevel stuff is keeping me from doing my actual work.
