For lossy compression, turns out a sinusoidal (typically DCT) composition maximizes energy compaction and compress ability. A proof that this is true for AR-processes was a key realization for me. That you get a nice and intuitive domain to work with (modify frequencies) is a nice bonus on top :)

OTH the smaller companies are usually not as interesting to patent trolls as there's not as much $$$ to be gained. In case of Apple, I believe the damage is related to number of infringing iPhones sold.
Also it would be in the trolls interest to be able to continuously sue a company rather than bankrupting it and destroy a revenue stream.
I guess one explanation for the robustness is that noise is typically additive and other types of distortions (loudness compression, eq, reverb, etc.) are usually linear filters, i.e. only modifies the amplitude (and phase) of already existing frequencies. If the underlying peaks are strong, this normally does not change peak locations.
I think the claim of it being impossible to patent algorithms in Europe is a bit overstated. In my experience, you just add "Method and apparatus that implements <whatever_algorithm>" and it's granted.
Pretty sure Shazam/Philips/Dolby patents cover Europe.
