yes, you just verified robinhood is a clearing broker. they are not a clearinghouse. imagine a clearinghouse as almost guilds brokerages set up to get a useful function they needed that banks do not want to provide. so you have a ton of clearing brokers and they all send their money to the clearinghouse and then they can just forget about everything other than order execution and settlement and ignore all of the hard problems in the middle. the clearinghouse is itself an institution that also has incentives, and one of them is “in periods of extreme volatility, i am going to increase the capital i require to be held here in order to be certain all of the middle bits can be executed”.

i have no idea why people think robinhood is a clearinghouse, that doesn’t make sense. they don’t want to do that! they want to do PFOF with execution or make settlement take 0 days so they can further take advantage of retail or whatever. being a clearinghouse sucks. no one likes you. banks don’t want to do your job.

i would say what you have outlined is consistent with “free speech”. germany, for instance, has very high freedoms while still restricting membership in nazi parties, displaying nazi iconography, publishing...etc.

i think if the line is delineated legally, explicitly, clearly that this restriction adds freedoms to those who would be restricted were free speech absolute and the screams of the intolerant drowned out their pleas for survival.

i think the perception this does not qualify as free speech because it is not absolutely free in a libertarian sense (i can say literally whatever sequence of things i can imagine, i can transmit literally any sequence of bits, i can portray literally anything in film/video games) is a strange and mostly american one.

to be clear: i agree free speech is important and am not particularly arguing against it in the american context here either—one thing that i think is better in sum in american is the high degree of press freedom due to america’s extremely high legal standard for libel. i just wanted to comment on the sociological phenomenon i see where there is “free speech” and “this other thing where it is free speech as most other places would recognize it”.

kids can absolutely reason morally, they just don’t have all the scaffolding to support doing so well or coming to reasonable conclusions. kids even reason about the nature of the terms themselves (especially around christmas: “why do i have to be good? what does being good mean?”).

but the same five year old who is picking the 10 dogs over the 1 human is also grabbing their toy from their little sister and bopping her on the head with it and making her cry, so i am not trying to defend some notion of a developed sense of toddler morality.
